If a product or service presents a safety risk or is non-compliant with a mandatory standard or ban, it may need to be recalled. You are responsible for staying informed about any mandatory or voluntary recall that may apply to your products. As soon as a seller is aware that any of the products it has sold or is selling on Kogan.com might or will be or are subject to a recall (whether mandatory or voluntary):
The Seller must:
- Immediately notify Kogan as to the details of the recall, and the actions it is taking and proposing to take to ensure it is complying and will comply with the requirements of the recall. This includes immediately contacting all customers affected by the recall.
- Immediately remove the relevant products from Kogan.com.
- Provide Kogan with regular updates, as requested by Kogan, as to the Seller’s compliance with the requirements of the recall.
- Indemnify Kogan in accordance with the Kogan Marketplace Agreement.
Most importantly, Kogan can at any time, take over the recall process (including communications with affected customers) if it is not satisfied that the Seller is adequately complying with the recall notice, in which case the Seller will provide whatever assistance is requested by Kogan.
